1. Acceptance of Terms
By accessing or using the GlobiPay platform (the "Platform"), including our mobile application, website, and related services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Platform.
GlobiPay is operated by Globiz ("Company", "we", "us", "our"), registered in Nairobi, Kenya.
2. Eligibility
To use GlobiPay, you must:
- Be at least 18 years of age
- Have the legal capacity to enter into binding agreements
- Provide accurate and complete registration information
- Comply with all applicable laws and regulations in your jurisdiction
- Not be a person barred from receiving services under Kenyan or international law
3. Account Registration
You may create an account using Google Sign-In or Apple Sign-In. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorised access or use
- Ensuring your account information remains accurate and up to date
We reserve the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.
4. Services Provided
GlobiPay offers the following services:
a) Escrow Transactions
GlobiPay acts as a neutral third-party escrow holder. Funds deposited by buyers are held until both parties confirm transaction completion. In case of disputes, GlobiPay's dispute resolution team will review and make a determination.
b) Event Ticketing
Users may create events, set ticket prices, and sell tickets through the Platform. Tickets include QR codes for validation. Event organisers are responsible for the accuracy of event details and fulfilment of event obligations.
c) Group Contributions (Pools)
Users may create contribution pools for weddings, harambees, fundraisers, and other group purposes. Pool organisers are responsible for the stated use of funds and transparent communication with contributors.
5. Payment Terms
- Deposits: Users can fund their wallet via M-Pesa (STK Push), Visa, or Mastercard
- Fees: GlobiPay charges service fees on certain transactions. Current fee schedules include: escrow funding fee (KES 150–1,000 flat tiered, buyer-side), event ticket service fee (2.5%), pool withdrawal fee (1.2%), and M-Pesa deposit fee (KES 30–200 tiered). Fee details are displayed before you confirm any transaction
- Withdrawals: Users may withdraw funds to M-Pesa or bank accounts. Processing times vary by withdrawal method
- Refunds: Refund eligibility depends on the transaction type and dispute outcome. Escrow refunds are processed when a dispute is resolved in the buyer's favour
6. Escrow Rules
- Funds are held in escrow until the buyer confirms receipt and satisfaction, or until the escrow period expires
- Either party may raise a dispute within the escrow period
- GlobiPay reserves the right to make final dispute determinations based on available evidence
- GlobiPay is not a party to the underlying transaction between buyer and seller — we act solely as an escrow intermediary
- A flat tiered escrow service fee (KES 150–1,000 depending on amount) is charged to the buyer upon funding. The seller receives the full escrow amount upon release
7. Prohibited Activities
You may not use GlobiPay for:
- Money laundering, terrorist financing, or any illegal financial activity
- Fraud, scams, or deceptive practices
- Selling illegal goods, services, or controlled substances
- Creating fake events, pools, or escrow transactions
- Circumventing security features, rate limits, or access controls
- Impersonating another person or misrepresenting your identity
- Distributing malware, viruses, or engaging in hacking activities
- Any activity that violates Kenyan law or international sanctions
8. Intellectual Property
All content, trademarks, logos, software, designs, and materials on the Platform are owned by or licensed to Globiz. You may not copy, modify, distribute, or create derivative works from our content without prior written consent.
User-generated content (event descriptions, pool details, etc.) remains your property, but you grant GlobiPay a non-exclusive, royalty-free licence to display and distribute such content on the Platform.
9. Limitation of Liability
To the maximum extent permitted by law:
- GlobiPay is provided "as is" without warranties of any kind, express or implied
- We do not guarantee uninterrupted, error-free, or completely secure service
- We are not liable for indirect, incidental, consequential, or punitive damages
- Our total liability for any claim shall not exceed the fees paid by you to GlobiPay in the 12 months preceding the claim
- We are not responsible for the actions, products, or services of third parties (including buyers, sellers, event organisers, or payment partners)
10. Indemnification
You agree to indemnify and hold harmless Globiz, its directors, employees, and affiliates from any claims, losses, damages, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.
11. Dispute Resolution
Platform Disputes: Escrow and transaction disputes are handled through GlobiPay's built-in dispute resolution process. Our team reviews evidence from both parties and issues a binding determination.
Legal Disputes: Any legal disputes arising from these Terms shall be governed by the laws of Kenya and subject to the exclusive jurisdiction of the courts of Nairobi, Kenya.
12. Termination
We may suspend or terminate your account at any time if you violate these Terms, engage in prohibited activities, or if required by law. Upon termination:
- Your access to the Platform will be revoked
- Pending escrow funds will be handled according to our dispute resolution process
- You remain responsible for any outstanding obligations
- Provisions that by nature should survive termination will remain in effect
13. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via the app, email, or website notice. Continued use of the Platform after changes constitutes acceptance of the revised Terms.
